‘Well done Harish Salve and Team India’: Twitter erupts with joy as ICJ stays Kulbhushan Jadhav’s execution

India had called on ICJ for an emergency hearing on Monday to suspend Pakistan's military court's death sentence to the former navy officer

The Internation Court of Justice on Thursday ordered Pakistan to not carry out the execution of  Kulbhushan Jadhav until it takes a final decision in the case. The top UN Court also ordered Islamabad to give consular access to Jadhav. The world court also rejected Pakistan’s argument that it did not have jurisdiction on the matter saying, the court would hear the case and seek arguments from both sides.

“Pakistan shall take all measures at its disposal to ensure that Mr Jadhav is not executed pending the final decision in these proceedings,” the UN court ruled.  “The circumstances of his arrest are in dispute…India has the right to seek consular access for Jadhav,” it added.  The president of the court, Ronny Abraham, pronounced the decision.

India has called on ICJ for an emergency hearing on Monday to suspend Pakistan’s military court’s death sentence to former navy officer. India argued that its case is solely based on the violation of the Vienna Convention on Consular Relations (VCCR) optional protocol. Pakistan, on the other hand had argued that the ICJ is not a criminal court and cannot decide such type of cases relating to national security. Jadhav was arrested in March 2016 on charges of espionage and involvement in terror activities. Pakistani officials claimed he had confessed to spying for Indian intelligence services. He was sentenced to death last month. Not to mention, India was waiting for the verdict with abated breath.
